TERMS OF SERVICE 

In these Terms you acknowledge the following: The Mojo Mecca is licensed, not sold to you, and you may use the app only as set forth in these Terms.

We are offering The Mojo Mecca to you without warranties of any kind. By accepting these Terms, we are agreeing to arbitrate any dispute between us.

If you are using the App on an iOS-based device, then you agree to and acknowledge the ‘Notice Regarding Apple’ below. 

The Mojo Mecca provides you with the ability to share photos, videos, and stories with a wider community. If you post any content of a derogatory, criminal or discriminatory nature on The Mojo Mecca, then we may take any remedial action that we, in our sole discretion, deem necessary and/or appropriate under the circumstances - such as, suspending or terminating your account, removing all of your content from The Mojo Mecca and/or reporting you to law enforcement authorities.

You may use The Mojo Mecca only if it fully complies with the laws of the country from which you are accessing it. 

The Mojo Mecca is for people aged 13 or older. If you are under 13, you must get your parent or guardian to agree to these Terms and supervise your use of The Mojo Mecca App. 

The Mojo Mecca is accessible via mobile phone, tablet, laptop or other devices. Your mobile carrier’s normal messaging, data, and other rates and fees will apply to your use of the Mobile Services. 

If you choose to register with The Mojo Mecca, you agree to: (a) provide true, accurate, current, and complete information as prompted by the registration form; and (b) maintain and update such information to keep it true, accurate, current, and complete. 

We reserve the right to investigate and terminate your use of The Mojo Mecca App in the event we, in our sole and absolute discretion, believe you have violated these Terms. 

If you think someone may have stolen your login or hacked your account, let us know right away by contacting us at hi@themojomecca.com.

When you join, you’ll be able to pick a username that will identify you on The Mojo Mecca App. You’ll have a fair amount of freedom to pick a screen name you like, but there are some ground rules: Be nice. No obscenities, references to illegal behavior, or terms that others might reasonably find to be threatening or abusive. Don’t use anything you don’t have the right to, like brands or company names or other proprietary terms or trademarks. Don’t use anything that suggests you are someone you are not, like any well-known person. We have the right to review, edit, reject, or delete any screen name. We can’t watch everything, so the fact that a screen name gets displayed on The Mojo Mecca App doesn’t necessarily mean we approve of it. 

You agree you won’t copy, upload, republish, broadcast, transmit, retransmit, post, create derivative works of, publicly perform, publicly display, distribute or use for any commercial purpose our name, logos, service marks or trademarks without our prior express written permission or as expressly permitted by The Mojo Mecca. We and our service providers own all design rights, databases and compilation and other intellectual property rights in The Mojo Mecca App.

All content that is posted to The Mojo Mecca App by a user is the sole responsibility of the user who originated it and/or from whose account it was posted. The User Content you post on The Mojo Mecca App is essentially public, so make sure you’re comfortable with that before you post.

We do not own User Content. Everything you might contribute to The Mojo Mecca App is your sole responsibility. If we are requesting use of your content for any external use, publication or project, it will only be shared with your consent and/or compensation.

If we are to include any of your content in advertising, promotions, targeted ads or in a commercial venture, this will only be with your consent and/or compensation.

We have no obligation to preserve, review, host, display or maintain any content posted by you or any other user. We can reject or remove it from The Mojo Mecca App at any time. We reserve the right to monitor all content posted to The Mojo Mecca App, and to take down anything we think should come down, with or without notice, and without any liability to you. We will endeavour to notify you when your content is removed, and will outline the reason. 

All content and materials provided on The Mojo Mecca App are intended for general information, general discussion, education and entertainment purposes only. Do not construe that such content is either endorsed or verified by us. 

Our vision for The Mojo Mecca App is for it to be nourishing, safe and informative for all people. Please use our space only for this purpose. 

DO NOT: 

• Post anything that is inappropriate for a family site - this includes obscenities, references to illegal behavior, violence or pornographic content (anything others might find threatening, abusive, derogatory, hateful, embarrassing, bullying, discriminatory or inflammatory).

• Post or transmit anything you don’t have the right to use – this includes: other people’s private and confidential information without their expressed authorization and permission (Intimate photos or videos, particularly if taken or distributed without the subject’s consent)

• Impersonate anyone (real or fictitious)

• Create a new account with The Mojo Mecca App, without our express written consent, if we have previously disabled an Account of yours

• Solicit, or attempt to solicit, personal information from other users of The Mojo Mecca App 

• Try to hack The Mojo Mecca App, or access anything you are not supposed to, like other user data, for example (including data-mining technology)

• Post or transmit spam or anything that might overburden, restrict, disrupt, circumvent the security measures of or harm The Mojo Mecca App – files too large for the infrastructure to handle, viruses, Trojans, bots, adware, malware, spyware etc.

• Use The Mojo Mecca App for any unlawful purpose or in furtherance of illegal activities 

• Engage in targeted abuse, stalking or harassment 

• Violate any local, state, national, or international law or regulation, or disobey any requirements, procedures or policies connected to The Mojo Mecca App

If you do any of the above things, we have the right to ban you from The Mojo Mecca App or take any other action we believe is appropriate. 

International users must comply with all local laws regarding online conduct and acceptable content. Users may use the "Report Post" feature to flag any post be reviewed and dealt with by an administrator. If it turns out any User Content, conduct or use is illegal, malicious or otherwise violates these Terms, we are not responsible — the user that posted such User Content is responsible. 

The Mojo Mecca App may contain links and pointers to other internet sites and resources. If you choose to follow any links to External Sites, then you proceed at your own risk. Such External Sites are not endorsed, sponsored, administered or operated by us.

We want The Mojo Mecca App to be a safe, inspiring and valuable place - however we cannot promise 100% that The Mojo Mecca App is accurate, reliable, secure or error-free; that it will operate or be accessible without interruption; or that The Mojo Mecca App will be free from viruses or other harmful components. It is your responsibility to review the information/services on The Mojo Mecca App and determine its effectiveness or accuracy.

YOU ACKNOWLEDGE AND AGREE THAT: 

– YOUR SOLE REMEDY FOR ANY PROBLEMS OR DISSATISFACTION WITH THE MOJO MECCA APP IS TO TERMINATE YOUR ACCOUNT AND DISCONTINUE ALL USE OF THE MOJO MECCA APP

– IN NO EVENT WILL ANY OF THE APP PARTIES BE LIABLE FOR ANY DAMAGES, WHETHER DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR SPECIAL, ARISING OUT OF OR RELATING TO USE OF, ACCESS TO, RELIANCE UPON, CONTENT OF, SECURITY OF, OR INABILITY TO USE THE MOJO MECCA APP OR ANY PART OF IT

– THE MOJO MECCA APP SHALL NOT BE RESPONSIBLE OR LIABLE TO YOU OR ANY THIRD PARTY (1) SHOULD WE MODIFY OR DISCONTINUE THE APP (2) FOR REMOVING YOUR USER CONTENT OR TERMINATING YOUR ACCESS TO THE APP (3) FOR ANY LOSS OR DAMAGE ARISING FROM YOUR FAILURE TO ADEQUATELY SAFEGUARD YOUR PASSWORD

You agree to hold The Mojo Mecca App harmless from and against all claims, actions, liabilities, damages and expenses (including court costs, legal fees, and amounts paid in settlement) arising out of or relating to: (a) your use of The Mojo Mecca App and/or (b) any actual or alleged violation of these Terms by you. 

If you believe a user of The Mojo Mecca App is infringing your copyright, trademark or other intellectual property right, please provide written notice to us. Our intellectual property policy is to remove or disable access to material that we believe is infringing the intellectual property of a third party by being made available through The Mojo Mecca App.

You agree to transact with us electronically. Your affirmative act of registering, using or logging into The Mojo Mecca App constitutes your acceptance signature to these Terms. 

You agree that we may provide you from time to time with automatic upgrades of our app, which you will accept for installation. Please note that certain retail application stores that offer our app may have separate sales terms that will be binding on you if you elect to download The Mojo Mecca App from such merchants. 

Our software is offered solely to individuals for personal, non-commercial use. Your use of the software must comply with all applicable laws and regulations and any other applicable jurisdictions. You may not copy, make derivate works, resell, distribute, or make any commercial use of (other than to keep and share information for your own non-commercial purposes) any content, materials, or databases from our network or systems. 

You may not sell, sublicense or redistribute our software applications or incorporate them into another product. You may not reverse engineer or disassemble the software or otherwise attempt to derive the source code or the communications protocol for accessing The Mojo Mecca App.

These Terms commence as of your first access or use of The Mojo Mecca App and continue until the termination of the Terms by either you or us. 

If any portion of any term in these Terms is declared unlawful, void or for any reason unenforceable by any court or arbitration panel, then all other terms will remain in effect and you agree that the court or arbitrator should endeavour to give effect to our intentions as reflected in these Terms; but, if such endeavour is impossible, then such portion will be deemed severable from the remaining term(s) and will not affect the validity and enforceability of such remaining terms. 

You agree that no partnership, employment, or agency relationship exists between you and us as a result of these Terms or your use of The Mojo Mecca App.

NOTICE REGARDING APPLE:

You acknowledge that these Terms are between you and us only, not with Apple, and Apple is not responsible for The Mojo Mecca App or the content thereof. Apple has no obligation whatsoever to offer any support services to The Mojo Mecca App. 

Apple is not responsible for addressing any claims by you or any third party relating to The Mojo Mecca App or your possession and/or use of The Mojo Mecca App, including, but not limited to: (a) product liability claims; (b) any claim that The Mojo Mecca App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection or similar legislation. 

Apple is not responsible for the investigation, defence, settlement, and discharge of any third party claim that The Mojo Mecca App or your possession and use of the App infringes that third party’s intellectual property rights. You agree to comply with any applicable third party terms, when using The Mojo Mecca App. Apple, and Apple’s subsidiaries, are third party beneficiaries of these Terms.

PRIVACY POLICY

This Privacy Policy explains how we collect, use and disclose information we obtain through The Mojo Mecca and information you give us.

When you access The Mojo Mecca, you agree to this privacy policy. 

The Mojo Mecca collects ‘Personal Information’ both when you register and during use. The Mojo Mecca also collects ‘Personal Information’ from social media websites/services when you link that social media website or service, when you input your location, or through your communications with The Mojo Mecca customer-support email hi@themojomecca.com. Please note, we do not consider ‘Personal Information’ to include information that has been anonymised. We also request that children under the age of thirteen do not access and provide ‘Personal Information’ to The Mojo Mecca. 

We use ‘Personal Information’ to suggest other topics, groups, or sites that you may like, communicate with you, and for other purposes contemplated in this Privacy Policy. We may send emails to the email address you provide to us to verify your account and for informational purposes, such as account management, customer support, events, or system maintenance. 

We use non-personal information in a variety of ways, including to help analyse site traffic, understand user needs and trends, carry out targeted promotional activities and to improve our services. We also reserve the right to use IP addresses to (a) identify a visitor when we feel it is necessary to enforce compliance with The Mojo Mecca rules; (b) fulfil a government request; (c) conform with the requirements of the law or legal process; (d) protect or defend our legal rights, The Mojo Mecca platform, or other users; or (e) in an emergency to protect the health and safety of The Mojo Mecca’s users or the general public. 

We and our third-party service providers receive and record information on our server logs from your browser, including your IP address, and from cookies/similar technology – for various purposes including system administration, reporting non-personal aggregate information to others, and tracking the use of The Mojo Mecca. Cookies are small text files placed in a user’s computer browser to store the user’s preferences. Most browsers allow you to block, refuse to accept and/or delete cookies. 

Please note that advertisers that serve advertisements on The Mojo Mecca may also use their own cookies and other technological tools which are subject to the advertiser’s privacy policies, not this Privacy Policy. 

The content you post to The Mojo Mecca may be displayed in any location on The Mojo Mecca, including, as featured content. Other users and nonusers may be able to see some information about you, such as information or photos that you have posted in your profile or in comments or posts, or your location if you enable your computer or mobile device to send us location information. Any information you share in a public forum like The Mojo Mecca is public information and may be seen, used or collected by anyone, including third parties that do not adhere to our Privacy Policy. We are not responsible for privacy practices of the other users or third parties, including those who view and use the posted information you choose to make available on The Mojo Mecca.

Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure the security of any information you provide or transmit to us. We do not accept liability and you agree that we are not liable or responsible for the unintentional disclosure, theft or destruction of your Personal Information or other information. Do not share any information on or through The Mojo Mecca if you are concerned about the unauthorized access to such information by a third party. 

If you would like to update or correct any information that you have provided to us through your use of The Mojo Mecca or if you have questions about or suggestions for improving this Privacy Policy, then please send an email to hi@themojomecca.com. We may revise this Privacy Policy, so review it periodically. You are responsible for ensuring your continued acceptance of this Privacy Policy and your continued use of The Mojo Mecca following a change in the Privacy Policy.
